1. Introduction

Welcome to Monkey Media ("we," "our," or "us"). These Terms & Conditions govern your use of our website (themonkeymedia.in) and the digital marketing, web development, ad shooting, and consulting services we provide. By accessing our website, booking our talent, or purchasing our services, you agree to be strictly bound by these Terms.

2. Services & Deliverables

Monkey Media provides digital services including but not limited to performance marketing, UGC content creation, cinematic ad shoots, and web development. Specific deliverables, timelines, constraints, and costs will be outlined in a separate invoice, proposal, or service agreement provided to you prior to the commencement of any project.

3. Pricing & Payments

  • All prices are listed in Indian Rupees (INR) unless otherwise stated explicitly in your invoice.
  • Payments must be made in full or according to the milestone schedule agreed upon in your invoice prior to the delivery of final assets.
  • We utilize secure third-party payment gateways (UPI, Credit/Debit, Netbanking). We do not store your raw banking or card details on our servers.
  • Failure to make timely payments may result in the immediate suspension of ongoing marketing campaigns, ad shoots, or web hosting services.

4. Cancellation & Refund Policy

Due to the custom nature of digital marketing, content creation, talent booking, and software development, our refund policy is strictly enforced as follows:

  • Standard Deduction: If a cancellation is requested and a refund is approved for any reason, a mandatory 20% processing and cancellation fee will be deducted from the total order value. You will only be eligible to receive a maximum of 80% of your initial payment.
  • Commenced Work: Once work has officially commenced on a campaign, ad shoot, or development project, payments are strictly non-refundable. The resources, time, and talent allocated cannot be recovered.
  • Ad Spend: Any money allocated directly for ad spend (Meta, Google, TikTok) is paid directly to the respective platforms and is entirely non-refundable by Monkey Media under any circumstances.
  • To request a cancellation prior to project commencement, you must email us immediately at hello@themonkeymedia.in.

5. Intellectual Property

Upon full and final payment, you own the final deliverables (e.g., final ad videos, final website code) unless stated otherwise in your specific contract. Monkey Media retains the explicit right to use the completed work, case studies, and performance metrics in our portfolio, website, and marketing materials to showcase our expertise.

6. Limitation of Liability

Monkey Media strives to deliver the highest Return on Ad Spend (ROAS) and quality of work. However, we cannot and do not guarantee specific financial results, sales volumes, or lead quantities, as market conditions, product viability, and platform algorithms are beyond our control. In no event shall Monkey Media be liable for any indirect, incidental, or consequential business losses.

7. Governing Law

These terms shall be governed by and constructed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Maharashtra, India.
